By indicating your agreement to these terms & conditions (or for example, by clicking the button where you accept these Terms & Conditions), you, in your individual capacity, represent and agree to the following.

• You are authorized on behalf of yourself and the business listed in the application (collectively the “Merchant”) to make and submit this application, to submit any accompanying documents, and to provide the consents and authorizations set out below.

• You are submitting this application to Liquidus Funding LLC and to third-party lenders, finance companies, and/or other third parties that are involved with or provide commercial loans or purchases of receivables (collectively “Servicers”).

• You and the Merchant: (1) acknowledge that by voluntarily providing your telephone number(s) and other contact information, you expressly agree to receive calls and messages from Liquidus Funding LLC, including without limitation cellular phone, (2) acknowledge that no purchase of goods or services is contingent upon such consent (3) acknowledge that you have read Liquidus Funding LLC’s Privacy Policy and understand that you may opt out of receiving communications of your choice from Liquidus Funding LLC as provided in the Privacy Policy

• Any applications submitted electronically shall have the same force and effect as if the application bore an inked original signature(s)

• If this application is approved, you are authorized to sign business financing documentation on behalf of the Merchant.  Please be advised that some business financing products may require a personal guaranty.

• All information provided to Liquidus Funding LLC and/or Servicers is accurate and complete and that you will immediately notify Liquidus Funding LLC of any change in such information.

• Liquidus Funding LLC and Servicers may rely on the accuracy of the information provided.

• Liquidus Funding LLC may share all information and documents with Servicers to fulfill Merchant’s requests.

• Liquidus Funding LLC and Servicers may share information they have about you and Merchant at any time for administrative, marketing and servicing purposes as permitted by law and that your personal information may be shared with the Servicer as part of the underwriting process.

• You and the Merchant waive and release any claims against any information provider relating to the release of information.

• You authorize Liquidus Funding LLC and Servicers to obtain consumer/personal and/or business and investigative financial and credit reports from one or more consumer reporting agencies (including, but not limited to, Experian, Equifax, Dun and Bradstreet, and TransUnion) and from other credit bureaus, banks, creditors and other third parties about Merchant.

YOU UNDERSTAND THAT THIS IS AN APPLICATION FOR PURCHASE OF FUTURE RECEIVABLES OR A COMMERCIAL LOAN AND THAT ANY FUNDS OFFERED TO APPLICANT MAY NOT BE USED FOR PERSONAL, FAMILY OR HOUSEHOLD PURPOSES.

Federal law requires all financial institutions to obtain, verify and record information that identifies each person and entity that opens an account or establishes a relationship with such institution, including name, address, date of birth, social security or tax identification number and other information that will allow the financial institution to verify your and/or the entity’s identity.  You may also be asked to provide identifying documents.
